Voter Privacy Information
Voter registration records are considered public information. A list of voters is available to the public upon request.
Protected Information: While voter registration records are generally public, certain personal information is private under 63G-2-302(j). A voter’s Social Security Number, Driver’s License or State ID number, email address, full date of birth, phone number, and signature are considered “private” for all voters and may only be disclosed to government entities for voter registration and the administration of elections purposes. Failure to provide necessary information such as your Social Security number, state ID number, complete date of birth, and signature on your voter registration form may prevent election officials from processing your application. Voter registration records are retained permanently under Utah Code 20A-2(104)(2)(c) and record series 28818. There are three categories of privacy for voter registration information: Public, Private, and Withheld.
Public: A list of voters is available to the public upon request, for a fee, under Utah Code 63G-2-201. Voter information that is available to the public includes: name, physical and mailing addresses, year of birth, party affiliation, and vote history (i.e., the elections in which the voter voted; not how the voter marked their ballots) This information is classified as public under Utah Code 63G-2-301(l). Protected information (see above) is not given out to the public.
Private: Voters may choose to make their registration information private at the time of registration (voter.utah.gov). When the voter elects to have their registration private, the personal information classified as private under Utah Code 63G-2-302(k) is not available to the public. Information for voters in this category is available to the following upon request and for a fee: government entities working in their official capacity, political parties, candidates, and their contractors, and must be used in accordance with the law, under Utah Code 20A-2-104(4). Information given to those authorized to access private voter information includes; name, physical and mailing addresses, year of birth, party affiliation, and vote history. Failure to provide necessary information such as your name, physical address, and full date of birth on your voter registration form may prevent election officials from processing your application. Protected information (see above) is not given to the public. Voter registration records are retained permanently under record series 28818.
Withheld: Certain voters may be eligible to make their record withheld from anyone other than a government entity in their official capacity under Utah Code 63G-2-302(l) through (m) and 20A-2-104(7) through (8). Personally identifiable information for voters in this category is anonymized, but non-identifying information such as physical and mailing addresses, age range, party affiliation, and vote history are provided upon request (Utah Code 20A-2(104)(4)(n) through (p)). Failure to provide necessary information such as your name, physical address, and full date of birth on your voter registration form may prevent election officials from processing your application. Protected information (see above) is not given out to the public. Voter registration records are retained permanently under record series 28818.
Voters who are eligible to be in the withheld category are as follows:
• A person who is a victim, or is likely to be victim, of domestic violence or dating violence
• Law enforcement officers
• Individuals protected by a protective or protection orders
• Members of the armed forces
• Public figures who have a higher safety risk due to their celebrity status or prominent position (does not include elected officials)
• A person who resides with a person described above.
